Agreement
These Terms of Service (“Terms”) are an agreement between you and headlessfleet.com, which operates HeadlessFleet (“we”, “us”). They cover HeadlessFleet’s website, dashboard, API, browser sessions and related services (together, the “service”).
By creating an account or using the service, you agree to these Terms. If you use the service on behalf of an organization, you agree to them for that organization and confirm that you have the authority to do so. “You” then includes the organization.
If you have a separate written agreement with us, such as for the Scale plan, that agreement controls wherever it conflicts with these Terms.
The service and the free beta
HeadlessFleet provides hosted Chromium browsers that you control over the Chrome DevTools Protocol (CDP), for example with Playwright or Puppeteer. Each session’s web traffic is routed through mobile carrier networks. The service also includes JSON jobs, saved browser profiles, live view and usage metering. We may add, change or remove features over time.
The Free plan is a beta. It’s provided as is, and its limits and features may change at any time; the current limits are on our pricing page. We may suspend or end free access at any time, and we make no commitment about uptime or availability on the Free plan.
Eligibility and accounts
You must be at least 18 years old to use the service. It’s intended for business and developer use, not personal or household use.
Give us accurate account information, including an email address that can receive mail, and tell us if it changes.
Each person or organization may have only one Free account. We may suspend or close additional free accounts.
Account and API key security
Keep your password and API keys confidential. We show each API key only once, when you create it, so store it somewhere safe.
You’re responsible for all activity under your account and your API keys, including activity by anyone you give access to and by your automation.
If you think your password or a key has been exposed, change the password or revoke the key in the dashboard right away, and tell us at [email protected]. Revoking a key blocks new requests made with it immediately, but it doesn’t end sessions that are already running: anyone who has a running session’s CDP or live-view link can keep using that session, and keep it running, until it’s stopped or reaches its time limit. So also stop any running sessions you don’t recognize.
Acceptable use
You may not use the service to:
- do anything illegal
- access accounts, systems or data without authorization, including through credential stuffing or account takeover
- commit fraud, or impersonate any person or organization
- send spam
- create, distribute or control malware
- attack, probe or overload any system or network, including ours
- infringe anyone’s intellectual property or privacy rights
- store or distribute child sexual abuse material or any other illegal content
- harass or threaten anyone
- get around usage limits or billing, for example by opening more than one free account
- resell the service, or provide it to third parties as a standalone proxy or browser product, without a written agreement with us
You’re responsible for your automation, including how it uses the sites and services it accesses, and for complying with the laws that apply to you. We may investigate suspected violations of these Terms and suspend your access while we do.
Fees and billing
Plans. The Free plan has no monthly fee and doesn’t require a card. Paid plans and prepaid credit are billed in US dollars through Stripe, our payment processor. Paid plans are charged monthly in advance, starting on the day you subscribe, and renew automatically until you cancel. An account can have only one paid subscription at a time.
Usage. Plans can include a monthly allowance of browser time and mobile-proxy traffic. Allowances reset on the first day of each month (UTC), whatever your billing date. Usage beyond your allowance, including on the Free plan, is charged at your plan’s rates, which are shown in Billing in the dashboard, and is deducted from your prepaid credit balance.
Metering. Browser time is counted per second, from when a session’s browser is ready until the session stops, including time the session is idle. Time a session spends queued isn’t counted. Mobile-proxy traffic is the bytes your sessions send and receive through the proxy; 1 GB is 1,000,000,000 bytes.
Idle sessions. A session is in use whenever data passes in either direction over one of its CDP connections, a live view of it shows you a new image of the page or passes your mouse or keyboard input to the page, or you call its heartbeat endpoint in the API. The rest of the time it’s idle: a connection that’s open but carries no data doesn’t count, and neither do keepalive pings or checking the session’s status. A session stops automatically once it has been idle for its idle timeout, which is 2 minutes unless you set another, and every session stops when it reaches its time limit. A live view shows a new image whenever the page changes, and several times a second for a manual (live view only) session. So while a live view is open on a manual session, or on a page that keeps changing, such as one playing video or animation, the session doesn’t go idle. If you leave that live view open, the session keeps running, and is billed, until you stop it or it reaches its time limit.
Prepaid credit. You can add prepaid credit from Billing in the dashboard. Credit pays for usage beyond your allowance. It doesn’t expire, and it can’t be transferred or exchanged for cash. If you’ve used your allowance and your balance runs out, we may stop your running sessions and refuse new ones until you add credit. If usage takes your balance below zero, the negative amount is deducted from credit you add later.
Taxes. Prices don’t include taxes. You’re responsible for any taxes that apply to your purchases, and where we’re required to collect them, we may add them to your charges.
Card statements. Charges for paid plans normally appear on your card statement with a descriptor that includes HEADLESSFLEET. We take payments through a Stripe account that we share with our affiliated mobile proxy businesses. Prepaid credit you buy by card appears as MOBILPROXY* HF CREDITS, and other payment methods may show a different descriptor. Stripe’s checkout pages and receipts may show that account’s business name. If you don’t recognize a charge, email [email protected] before disputing it with your bank.
Plan changes and cancellation. To switch to a different paid plan, email [email protected]. We’ll change your current subscription and tell you when the change takes effect. To cancel a paid plan, use Stripe’s customer portal, which you can open from Billing in the dashboard, or email us. The portal, or our reply to your email, tells you when a cancellation takes effect. You keep your paid plan until then, and your account then moves to the Free plan.
Refunds. Fees and prepaid credit are non-refundable, except where the law requires a refund.
Price changes. We may change our prices. We’ll give you notice by email or in the dashboard before a price increase applies to you.
Failed payments. If a subscription payment fails, you keep your paid plan while Stripe retries the payment, and you can update your payment method in the customer portal. If Stripe stops retrying and cancels the subscription or marks it unpaid, your account moves to the Free plan. Your paid plan comes back if the subscription becomes active again, for example after you pay the unpaid invoice. A failed payment doesn’t suspend your account automatically, but if an amount you owe stays unpaid, we may suspend your account until it’s paid.
Your content
“Your content” means the data you and your automation put into or get out of the service, such as job inputs and results, screenshots and PDFs, saved browser profiles, and the traffic your sessions send and receive.
You own your content. You give us a non-exclusive, worldwide, royalty-free license to host, copy, process and transmit it, only as needed to provide, secure and support the service. You’re responsible for your content and for having the right to use it with the service.
Our systems process your content automatically to run the service. Our staff access it only when needed to provide the service, when you ask us for help, to investigate a security problem or a suspected violation of these Terms, or when the law requires it.
Our property and feedback
We and our licensors own the service, including its software, documentation and brand. These Terms give you the right to use the service as described here, and no other rights.
If you send us feedback or suggestions, we may use them without any obligation to you.
Suspension and termination
You can stop using the service at any time. To close your account, email [email protected] from the address on your account. We’ll cancel any paid plan and then delete your account and its content, as described in our Privacy Policy.
We may suspend or end your access to all or part of the service if you break these Terms, don’t pay what you owe, put the service, other customers or anyone else at risk, or if the law requires it. When we reasonably can, we’ll give you notice.
While your account is suspended, you can still sign in to the dashboard and see your account, sessions, jobs, profiles, API keys, usage and billing. You can also pay through Billing, including buying a plan or prepaid credit and using Stripe’s customer portal, and you can stop sessions, cancel jobs and revoke API keys. You can’t start sessions or jobs, connect to sessions over CDP or live view, keep sessions alive or change their proxies, create, save or delete profiles, or create or change API keys, and every request made with your API keys is refused.
Sessions and jobs still waiting in the queue when your account is suspended fail, and they won’t start later. Once the suspension ends, you can start them again. Open CDP and live-view connections are closed. Sessions that are already running aren’t stopped straight away, but nothing can keep them in use, so each one stops at the end of its idle timeout, or at its time limit if that comes first, unless you stop it sooner. Their usage until then is billed as usual. A job that’s running fails and isn’t retried, unless it finishes first.
When your account ends, your right to use the service ends, you lose access to your content, and we may delete it. Download anything you need first: job results and files are available through the API, but saved profiles can’t be exported. Fees and prepaid credit aren’t refunded when an account ends, except where the law requires it.
Terms that by their nature should continue after your account ends, including payment obligations, disclaimers, limitation of liability and indemnity, continue to apply.
Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the service will be uninterrupted or error-free.
Mobile carriers assign IP addresses dynamically and share them among many of their users, so the IP addresses your sessions use change over time and are also used by other people. We don’t guarantee that a particular IP address, location or carrier will be available.
We don’t guarantee that any third-party website or service will be reachable through the service, or how it will respond.
We don’t guarantee that stored content, such as saved profiles and job files, can never be lost. Saved profiles aren’t included in our backups. Keep your own copies of anything you can’t afford to lose.
Limitation of liability
To the extent the law allows:
- we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if we were told they were possible
- our total liability for all claims relating to the service or these Terms is limited to the greater of the fees you paid us in the 12 months before the claim or US$100
Some jurisdictions don’t allow these limits, so they may not fully apply to you.
Indemnity
You will defend and indemnify us and our affiliates, officers and employees against any third-party claim, and the resulting losses, damages, fines and costs (including reasonable legal fees), to the extent the claim arises from your content, your use of the service (including your automation and the sites and services it accesses), or your breach of these Terms or the law.
Changes to these Terms
We may update these Terms. We’ll post the new version on this page and change the “Last updated” date. If a change is material, we’ll notify you by email or in the dashboard before it takes effect.
If you keep using the service after a change takes effect, you accept the updated Terms. If you don’t agree, stop using the service and close your account.
General
- These Terms, and any separate written agreement with us, are the entire agreement between you and us about the service.
- If any part of these Terms can’t be enforced, the rest stays in effect.
- If we don’t enforce a right, we haven’t waived it.
- You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
